INTERNET TERMS OF SERVICE

Range 2000 Systems Limited ("R2K") provides Internet services ("Services") to the Customer on the following terms and conditions ("Terms"). Services include, but are not limited to, Domain Name registration, web site development, we site hosting (provision of web space), web site maintenance and dial-up accounts. These Terms may be revised, without notice, at any time, at the sole discretion of R2K. Usage of any R2K Service is assumed to indicate acceptance of these Terms and forms an Agreement between R2K and the Customer. R2K reserves the right to use third party suppliers for the provision of web any Services.

DOMAIN NAME REGISTRATION
Domain Name registration is subject to the availability of the requested Domain Name, and the Customer accepts that registration may take up to 5 working days from the date of payment and receipt of full details.

Existing Domain Names can be transferred to the management of R2K and this can take up to 15 working days from receipt of authorisation from the registered administration contact.

R2K shall not be requested or required to release the Domain Name and may refuse to do so until this Agreement has been lawfully brought to an end and all sums due hereunder have been received by R2K, and the Customer has complied with all its obligations hereunder. Domain Names remain the property of R2K until all sums due have been received.

WEB SITE HOSTING & WEB SPACE USE
The Customer acknowledges that the web site hosting service may take up to 10 working days from the date payment has been received until it is fully operational. This is not a guarantee and R2K will not be responsible for any delay in provision beyond this time. 

Customer web space is to be used by the primary owner only. Customers are not permitted to resell, store or give away web hosting services of their web space to other parties without the prior consent of R2K. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

R2K does not allow any of the following content to be stored on web space provided by R2K:

• Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
• Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of R2K.
• Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Where Customer web sites are not maintained by R2K, the Customer has sole responsibility for ensuring that any data is suitably backed-up. R2K will not keep backups of Customer pages. For web sites maintained by R2K, R2K will maintain backup copies. Unless agreed otherwise, all requests for Customer web site updates should be sent to R2K by e-mail. R2K shall endeavour to update the site within 5 working days. This is not a guarantee and R2K will not be responsible for any delay beyond this time.

R2K reserves the right to suspend or cancel the Customer's access to any or all web space provided by R2K if R2K decides that the web space has been inappropriately used or otherwise. On cancellation, the relevant data on this web space will be deleted.

VIRUSES
Whilst R2K will take all reasonable steps to ensure that any media supplied to the Customer as part of the Services is free from viruses, R2K does not offer a guarantee that this will be the case.

Virus protection of any equipment owned or used by the Customer in relation to the Services provided by R2K is the responsibility of the Customer. Any work carried out by R2K to remove a viruse, or to assist the Customer to remove a virus, from this equipment will be charged to the Customer.

DIAL UP ACCOUNTS
Dial up accounts using a local rate 0845 number will be offered to Customers whose web site is hosted by R2K. R2K do not currently charge for this Service but reserve the right to charge at any time by giving 30 days notice to the Customer. R2K will not be liable for any telecommunication charges incurred by the Customer when using this type of account.

The Customer acknowledges that dial up accounts may take up to 5 working days from the date the request is received from the Customer until they are fully operational. This is not a guarantee and R2K will not be responsible for any delay beyond this time. Standard dial up accounts are for a single user only. Customers may only have one dial up connection per account at any one time.

Login names and passwords must be kept secret and not communicated to any third party. R2K must be notified immediately if they are compromised. This also applies to any user names and passwords provided to access the Customers web space.

Customers may not download or store illegal copies of commercial software. If commercial software is stored on our servers, R2K will delete the files and immediately terminate the account without recompense.

Any attempt to breach the security of any machine is forbidden. Attempting to do so will result in immediate account termination and possible further legal action. Customers may not run any program that monitors network packet data or any program that compromises the privacy of network traffic.

Customers may not abuse, or make physical threats against, another person via e-mail, news or any other electronic media/Service provided by R2K. Customers may not forge e-mail or news postings (to include cancel messages, whether manual or automated). Customers may not "spam" people via e-mail - this is defined as unsolicited (unwanted, unrequested) e-mail. When using newsgroups, Customers must comply with the globally accepted Usenet Acceptable Use Policy. This can be found at http://www.usenet.org.uk/usenet-information.htmlml

R2K reserves the right to suspend or cancel the Customer's dial up account provided by R2K if R2K decides that the account has been inappropriately used or otherwise. On cancellation, the relevant data on this account will be deleted.

UNLIMITED USE POLICY
R2K offers an unlimited use policy. However, if R2K considers a Customer to be using resources to such an extent that he or she may jeopardize performance and resources for other Customers or users of the resources, R2K reserves the right to suspend that site immediately. Customers may be offered an option whereby R2K continues hosting the website for an additional fee. Resources are defined as bandwidth and/or storage/processor utilization.

PAYMENT POLICY
All web hosting accounts are set up on a prepay basis. Although R2K reserves the right to change prices of Services at any time by giving 30 days notice to the Customer, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the Service was established. Customers will automatically be charged again for web hosting at the end of their prepay period unless closure notification has already been given.

R2K reserves the right to suspend Services until any outstanding debt is cleared. The Customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

Invoices will be sent by regular mail unless specifically requested by the Customer. All invoices will be sent directly to customers shortly after the purchase has been made for web hosting, and dial up accounts where chargeable, and upon completion of the work for web development services. For larger projects, R2K may request a deposit.

All payment is in UK sterling and is subject to VAT at the prevailing rate.

Payment Options
In order to streamline our accounting procedures and keep costs down R2K runs a limited number of payment options.

Standing Order: This option is available where Services are paid for on a monthly basis.

Cheque Payment: For web hosting, this option is only available to customers who pay annually. R2K cannot guarantee that a service will be provided until after any received cheques have been cleared.

CUSTOMER DETAILS
Customer must notify R2K of any change of contact details. All contact details will remain confidential and R2K will not supply this information to third parties, other than when requested by a recognised legal authority.

CHANGES TO THE SERVICE
If any supplier of R2K shall discontinue the provision of services to R2K or shall alter by modification, expansion, improvement, maintenance or repair the services or any part thereof, R2K shall be entitled to discontinue, alter, modify, expand, improve, maintain, repair, suspend, disconnect or otherwise change the services supplied to the Customer as necessary.

CANCELLATION AND REFUNDS
R2K reserves the right to cancel Services at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of service. If a customer contravenes R2K Terms, a refund will not be issued in the event of a cancellation. Fees charged on a prepay basis are non-refundable. In addition some Services may incur set-up fees, these fees are also non-refundable.

Customers may cancel their dial-up account or web space at any time. During the initial 30 days customers who wish to cancel may be offered a refund or partial refund for their hosting fees less any expenses incurred by R2K. Refunds will only be given if in the opinion of R2K, R2K has not provided a satisfactory Service and will be at the sole discretion of R2K and not open to negotiation..

If cancellation is not the result of contravention of R2K Terms, R2K will offer reasonable assistance to the Customer to transfer data held on the Customers web space and the Domain Name to another provider. R2K reserves the right to charge the Customer for this assistance.

INDEMNIFICATION
The Customer agrees that it shall defend, indemnify, save and hold R2K harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against R2K, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the Customer, its agents, employees or assigns. The Customer agrees to defend, indemnify and hold R2K harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Services provided by R2K; (2) any material supplied by the Customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold by the Customer from Services supplied by R2K.

DISCLAIMER
R2K will not be responsible for any direct or indirect damages, loss of profits, goodwill or other loss the Customers' business may suffer whether or not caused or arising from an act or omission of R2K, its employees, agents or suppliers. R2K makes no warranties of any kind, expressed or implied for Services provided. R2K disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by R2K  its agents, officers and employees. R2K reserves the right to revise its policies at any time

LAW
These Terms and all other agreements are governed by English Law and both parties submit to the exclusive jurisdiction of the English courts.
